The purpose and meaning:

This is a short film, but it could also be a commercial for the inclusion of Ferrero Rocher chocolate. Because we used a specific brand of chocolate and not just unbranded chocolate in general, we are responsible for ensuring we are following copyright laws and not infringing on any of the rights of Ferrero Rocher.

In order to use the actor’s images in this film, I had to get them to sign agreement release forms. This information shows what such a form should include: 

The consent form should be written in plain language free from jargon. It should allow the participant to clearly respond to each of these points:

• the participant has read and understood information about the project
• the participant has been given the opportunity to ask questions
• the participant voluntarily agrees to participate in the project
• the participant understands that he or she can withdraw at any time without giving reasons and without penalty
• procedures regarding confidentiality are explained (use of names, pseudonyms, anonymisation of data, etc.)
• separate terms of consent for interviews, audio, video or other forms of data collection
• use of the data in research, publications, sharing and archiving are explained
• signatures and dates of signing for the participant and the researcher

Copyright is a legal right created by the law of a country that grants the creator of an original work exclusive rights for its use and distribution. This is usually only for a limited time.

The participant should be given a copy of the form and the researcher should retain the signed original.

This is the Legal Notice taken from the Ferrero Rocher website. I have highlighted the portion that says that the material on the website can be used for personal and non-commercial use. This is repeated to include the product in general and not just the images and video on the website. 

I should not run into legal issues with using this chocolate in my film. It is for personal use, because it is for a school project as I am learning to make films and navigate the film industry. It is non-commercial use because I am not profiting from this video, nor am I selling anything else by using the chocolate.
